Each party attends a private intake session with the mediator. This step ensures mediation is appropriate, explains rights and responsibilities, and identifies key property and financial issues to be addressed.
Both parties must supply all of the ir disclosures. That is identify assets, liabilities, superannuation, and financial position. This information forms the foundation for informed discussions and realistic settlement options.
Structured mediation sessions are held in a neutral and respectful environment. The mediator facilitates discussion, supports balanced participation, and helps parties explore fair and practical settlement options. (This can be done online and if necessary without parties needing to see or talk directly to each other)
If agreement is not reached on all issues during the mediation, the mediator may then liase directly with each party in writing, to get each parties perspective on each issue, until agreemetn is reached
When agreement is reached, another mediaton session is set for a legally binding document to be created that can be lodged with the court, once it is signed by bothe parties
The parties then lodge the completed, signed document with the court
